Emergency rights topics
General rights
- Right to know the exact reason for your arrest immediately (unless caught in the act).
- Right to remain silent until your lawyer is present. Do not speak or write any statement without counsel.
- Right to demand a proper arrest warrant unless the arrest falls under emergency circumstances.
- Right to contact a family member, friend, or legal practitioner immediately.
- Absolute protection from torture, beating, or extortion (Section 34).
Practical steps
- Remain calm, polite, and cooperative with physical instructions. Do not resist physically as it can trigger escalations.
- Say clearly: 'I wish to consult with my lawyer before answering any questions or writing a statement.'
- Never sign a blank paper or pre-written statement sheet under force. If forced, sign your normal signature but do not admit guilt.
- Memorize the name, badge number, and patrol vehicle registration of the arresting officers if visible.
NEVER WRITE A STATEMENT WITHOUT A LAWYER'S PRESENT.
